PointGo Passenger Terms of Use

PointGo is a technology platform that digitally connects passengers with legally operating commercial taxi drivers. PointGo does not directly provide transportation services; it provides technology intermediation, trip request routing, payment convenience, safety and communication infrastructure between passengers and drivers.

1. Registration and Membership

A passenger may use the application after downloading PointGo, completing the required registration information, verifying the GSM number by SMS and accepting these Terms of Use. The passenger confirms that all registration information is accurate, complete, current and belongs to them. The passenger is responsible for all actions and requests made through the account. PointGo may review, suspend or terminate accounts for security, legal compliance, fraud prevention and abuse prevention.

2. Use of the Application

The passenger may create a taxi request by setting a pickup location in the application. PointGo attempts to route the request to a suitable and available legal commercial taxi. After a driver accepts the request, the passenger may see the driver’s name, vehicle plate, vehicle details, estimated arrival time and live location. Estimated arrival, distance, route and fare information may change due to traffic, road conditions, weather, GPS deviations, driver route choices or technical issues. The passenger may cancel a request; however, repeated cancellations, unnecessary waiting, misuse or conduct disrupting the platform may result in cancellation fees, account restrictions or suspension.

3. Trip and Fare Calculation

Trip fares may be calculated according to the pricing system shown in the app, lawful taxi tariffs in the relevant city, distance, time, route, traffic density and any additional service fees. Authorized commercial taxi tariffs in Istanbul and other applicable cities may be taken into account. A pre-trip price may be shown as an estimate or as a fixed fare. Bridge, highway, tunnel, parking, airport access and similar third-party charges may be added. PointGo is a technology platform and is not responsible for direct performance of transport, driver conduct, traffic violations or route choices.

4. Payment System

The passenger may pay by credit card, debit card, PointGo wallet balance or cash when available. By adding a card, the passenger authorizes the selected card to be charged at the end of a trip. Card storage, tokenization, payment security and payment infrastructure are handled through licensed payment institutions and technical providers. PointGo may apply 3D Secure, card verification, risk checks and transaction monitoring. If payment cannot be collected, the passenger must pay using another saved card, a new card, wallet balance or cash. Unauthorized use of a third-party card is the passenger’s sole legal responsibility.

5. Wallet System

PointGo may provide an in-app wallet or balance system. The passenger may top up the wallet and pay trip fares using this balance. Wallet balances are not kept in PointGo’s own commercial account; they are managed through payment institutions and related financial infrastructure.

6. Cash Payment

If offered in the application, the passenger may choose cash payment. In cash trips, the fare is paid directly to the driver. The passenger remains responsible for fulfilling the payment obligation.

7. Tips

PointGo may allow the passenger to tip the driver. Tipping is optional and entirely at the passenger’s discretion. A tip may be charged with the selected payment method or paid to the driver in cash.

8. Driver and Vehicle Safety

Drivers on the PointGo platform are persons authorized to provide legal commercial taxi services. PointGo may check identity, vehicle, plate, license, commercial taxi eligibility and required documents. Digital verification, document checks, face verification, liveness checks and third-party verification systems may be used. The passenger agrees not to damage the driver or vehicle, not to act unlawfully and to comply with general safety rules during the trip.

9. Trusted Contacts and Location Sharing

PointGo may offer trusted contacts or similar safety features. The passenger may authorize trip information such as driver name, vehicle plate, route, live location and trip status to be sent by SMS, notification or link to selected contacts. The passenger confirms that trusted contact details were lawfully obtained. PointGo does not guarantee uninterrupted, error-free or instant delivery of such notifications.

10. Requesting a Taxi for a Guest Passenger

The passenger may request a taxi for a third party. In doing so, the passenger confirms they are authorized to share the guest passenger’s name, phone, location and trip information with PointGo, that the data was lawfully obtained and that the guest passenger is informed. Payment, cancellation, safety and usage responsibilities may belong to both the passenger and the guest passenger.

11. Campaigns, Promotions and Discounts

PointGo may offer campaigns, promotions, discounts, referral codes or loyalty benefits. Campaign terms are determined by PointGo and may be announced in the application. The passenger agrees not to abuse campaigns, create fake accounts, collude with drivers or exploit system vulnerabilities. In case of abuse, PointGo may cancel campaign rights, reclaim discounts, suspend the account or terminate membership.

12. Complaints, Ratings and Support

After a trip, the passenger may rate the driver, leave a score or submit a complaint. PointGo may review complaints, warn drivers, restrict driver platform use or take other necessary measures. PointGo is not directly responsible for driver conduct but takes reasonable measures to improve platform safety and service quality.

13. Items Left in the Vehicle

If an item is left in a vehicle, the passenger may contact PointGo support. PointGo may assist by contacting the relevant driver and helping the parties communicate. PointGo is not responsible for finding, safeguarding, delivering or damage to forgotten items. Any travel, transport or additional costs for return of an item may belong to the passenger.

14. Protection of Personal Data

PointGo processes personal data in accordance with applicable legislation, including Turkish Law No. 6698 on Protection of Personal Data. Identity, contact, location, trip, payment, device, transaction security and support records may be processed to provide the service, ensure safety, process payments, meet legal obligations, provide customer support and resolve disputes. Servers and technical infrastructure may be hosted on secure cloud infrastructure such as Amazon Web Services. Passengers may exercise their data protection rights by contacting PointGo.

15. Technical Infrastructure and Interruptions

PointGo takes reasonable technical measures to keep the application continuously available and error-free. However, interruptions may occur due to internet outages, GPS errors, carrier issues, device problems, payment provider failures, map services, third-party APIs or force majeure. PointGo is not responsible for technical failures outside its reasonable control.

16. Passenger Obligations

The passenger agrees to use the application lawfully; not to create accounts with false, misleading or third-party information; not to harm drivers, vehicles or third parties; to fulfill payment obligations; not to misuse the PointGo system; not to create fake requests, fake accounts, campaign abuse or fraudulent transactions; and not to unlawfully share information obtained through the application.

17. Termination of Membership

The passenger may terminate membership through the application or PointGo support channels. PointGo may suspend or terminate membership if the passenger breaches these terms, fails to pay, endangers safety, conducts fraudulent activity or misuses the system. Termination does not remove payment obligations or responsibilities arising from previous trips.

18. Intellectual Property Rights

The design, software, source code, brand elements, logos, interfaces, databases, content, algorithms, business model and all intellectual property rights of the PointGo application belong to PointGo or its licensors. The passenger may not copy, reproduce, reverse engineer, commercially use or transfer the application without PointGo’s written permission.

19. Changes to the Terms

PointGo may update these Terms of Use due to legislation, operational needs, technical developments or business model changes. Updated terms become effective when published in the application or on the website. Continued use of the application means acceptance of the current terms.

20. Force Majeure

Natural disasters, war, civil unrest, strikes, epidemics, internet outages, infrastructure failures, power cuts, cyberattacks, public authority decisions, payment system failures, map service provider issues and events outside PointGo’s reasonable control are force majeure. PointGo is not liable for delayed, incomplete or non-performance caused by force majeure.

21. Validity of PointGo Records

The passenger accepts PointGo’s electronic records, system logs, payment records, call records, location records, support records, database records and commercial books as valid and binding evidence in disputes. This clause is an evidentiary agreement under Article 193 of the Turkish Code of Civil Procedure.

22. Governing Law and Jurisdiction

These Terms of Use are governed by Turkish law. Istanbul Central Courts and Enforcement Offices have jurisdiction over disputes arising from these terms.

23. Effectiveness

These Terms of Use become effective when the passenger gives electronic approval through the application. By registering, creating a trip request or using the application, the passenger declares that they have read, understood and accepted these Terms of Use.
